Minn. Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees: Cage protection, or ladder safety devices in lieu of cage protection, were not used on tower, water tank or chimney ladders over 20 feet in unbroken length. A poly rope ladder with 31 wooden rungs that were 12 inches apart was used for entry and access to the bottom of Madison Lake water tank, approximately 30 feet, without any type of fall protection.ly
