Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees: The employer failed to provide written safety procedures, a safe method of rail car movement, along with hazard recognition and training in safe procedures for movement and placement of rail cars. On 07/29/02, an employee was fatally injured when attempting to move and place a rail car for unloading.
