North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: a)facility - in the "lowerator" hoist #93 area, it was found that employees were performing work under the carriage, without having the carriage stop engage protecting them in the event of a free fall due to cable breakage or other mechanical failure. REFERENCE: ANSI B20, Section 6.18 Note: an acceptable mean of abatement would be to the installation of a positive carriage engagement to limit the possibility of free fall and/or restrict access around and under the carriage .
