Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or before June 21, 2002, employees were allowed to drive vehicles that were to be scrapped over to the preparation area without some determination as to the safe operation of the vehicle, i.e., brakes, steering, etc. Among other methods, one feasible and acceptable method for abatement is to initiate a safety rule ensuring that no employees are to drive vehicles that are to scrapped to the preparation area. Instead, have all employees use a forklift/bobcat to move the vehicles.
