General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: Employees were exposed to the hazard of asphyxiation due to the presence of an oxygen deficient atmosphere from the release of nitrogen gas into the workplace from the Cryo-grind mill. Feasible and useful abatement methods include, but are not limited to, the following: 1. Repair and maintain the ventilation system to prevent the displacement of oxygen at the Cryo-Grind mill. 2. Interlock the ventilation system with the ventilation system so that the nitrogen will not be supplied to the system if the ventilation fails. 3. Install a fixed monitoring system in the Cryo-Grind mill room so that employees will be warned about an oxygen deficient atmosphere prior to entering the room. 4. Shut down the operations and evacuate the facility when oxygen levels reach less than 19.5 percent in the work areas adjacent to the millroom enclosure. 5. Require all employees entering the mill room while the mill is running to wear appropriate personal protective equipment.
