5(a)(1):  Section 5(a)(1) of the Occupational Safety and Health Act of
1970:  the employer did not furnish
employment and a place of employment which were free from recognized
hazards that were causing or likely
to cause death or serious physical harm to employees:
Employees were exposed to hazards of fire resulting from the use of
apparatus used to process flammable and
combustible liquids in the water laboratory:
Provisions had not been made to prevent the release, accumulation and
ignition of gasoline and other vapors
from a filtering apparatus on or about 12/14/02. Among other methods, one
feasible and acceptable abatement
method to correct this hazard is to implement control measures and
procedures in accordance with NFPA 45
(National Fire Protection Association) Standard on Fire Protection for
Laboratories Using Chemicals, 2000
edition.  Specific procedures include, but are not limited to, provision
for ventilation to prevent accumulation
of ignitable concentration of vapors in the work area and the protection
from ignition sources (Section 9.1.4),
by containing the apparatus in a properly designed and equipped laboratory
hood.
Note:  It is also recommended that all vacuum pumps used in the laboratory
be vented to a safe outdoor
location.y
