Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: An employee was exposed to a fall hazard while walking on the conveyor. Among other methods, one feasible method to correct the hazard is to lockout the conveyor to prevent accidental, or intentional start-up while the employee(s) is on it. A second method is to enforce the company's policy of staying off the conveyor while it is stationary or moving.
