29 CFR 1910.5(a)(1): The employer did not provide the employees with a place of employment which was free from a recognized hazard. Reference: N.J.A.C.12.10-5.8(b): The employer did not report every fatality or in-patient hospitalization orally and in writing within eight hours to the Commissioner of Labor. The reporting may be by telephone or by electronic data transmission. LOC: Hospitalization of Police Officer Cynthia Rongione, which occurred on June 8, 2002 at or about 8:56 am. The First Report of Accidental was received in the Office of Public Employees Occupational Safety and Health on June 10, 2002, at 10:30 am and not as required within the eight hours of the inpatient hospitalization or fatality. Comment: The reporting may be by telephone or electronic data transmission and the written report required by the above shall mean the execution of the employers First Report of Accidental Injury or Occupational Disease. NOTE: In addition to the penalty, the employer is required to submit to the Office of Public Employees Occupational Safety and Health a written procedure providing that in all such future instances a report will be made immediately to the New Jersey Department of Labor, Office of Public Employees Occupational Safety and Health using the Hot Line #1-800-624-1644 and/or Facsimile #609-292-3749.
