29 CFR 1910.5(a)(1): The employer did not provide the employees with a place of employment which was free from a recognized hazard. N.J.A.C.12:10-5.8(b): The employer did not report every fatality or in-patient hospitalization orally and in writing within eight hours to the Commissioner of Labor. The reporting may be by telephone or by electronic data transmission. LOC: Hospitalization of Martin Keough, Painter, which occurred on June 6, 2002. Reference: Previous citation and penalty from Inspection # AN55-18-027, Issue Date May 8, 2001. The First Report of Accidental Injury was received in the Office of Public Employees Occupational Safety and Health on July 25, 2002 and not as required within the eight hours of the inpatient hospitalization or fatality. Comment: The reporting may be by telephone or electronic data transmission and the written report required by the above shall mean the execution of the employers First Report of Accidental Injury or Occupational Disease.
