Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards: a) Basement - Employees were permitted to ride the sidewalk elevator (Box Car #6) to transport trash dumpsters from the basement to ground level. This condition exposed employees to possible crushing hazards from the car platform and the confines of the shaftway. Abatement: Among other methods, one feasible method of abatement would be to restrict employees from riding the sidewalk elevator (Box Car #6). Alternatively the elevator could be redesigned and re-rated in accordance with the applicable A.N.S.I. standard to accommodate transportation of freight and passengers. NOTE: ABATEMENT DOCUMENTATION REQUIRED.TION
