Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious harm to employees in that employees were exposed to crushing hazards: Throughout Work Area: Employees operating forklifts were not utilizing the seatbelts which were equipped on the vehicles. a) Delco Metals, Inc. - The employer failed to enforce the use of the seatbelts which come equipped on forklifts. Operators routinely travel approximately 100 yards across a major street while delivering material from one building to another. Observed on or about 7/16/07 NOTE: ABATEMENT CERTIFICATION REQUIRED AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO ENFORCE THE WEARING OF THE SEATBELTS BY FORKLIFT OPERATORS.
