Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to employees in that employees were exposed to the hazard of
the dock plate
not functioning properly while the dock plate was in use the dock plate
hold down
mechanism would release allowing the dock plate to raise in a vertical
position instead of
staying in a horizontal plane when in use.  This created a gap between the
truck bed and the
raised dock plate where material handlers could fall between the raised
dock plate and the
truck.
1800 East Front Street, Kansas City, MO:  The dock plate would not stay in
place when
materials were being unloaded from the truck.
On or about September 24, 2002, a delivery vendor was injured when using
the dock plate
when unloading the delivery truck.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to repair or replace the dock plate.
Abatement certification is required for this violation (using the
CERTIFICATION OF
CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating
that
abatement is complete must be included with your certification.  This
documentation may
include, but is not limited to, evidence of the purchase or repair of the
equipment,
photographic or video evidence of abatement, or other written records.
