Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)An employee working on water tower at 24th and Main in Independence, Missouri, was using a carabineer as a descent device to rappel down leg of water tower to remove cell phone attachment in order to facilitate the removal of antenna from tower. Equipment manufactured to rappel down towers are figures of eight and descent devices. Manufactures of carabineers recommend their use only for fall protection device attachment. Employee did use carbineer to rappel down tower and the locking latch on carabineer did spin open allowing descent rope to slip out. Feasible methods to prevent this type of accident include but are not limited too. (1)Prohibiting use of equipment for uses other than intended (2)Supervision approval of rappelling equipment and connection prior to use. (3)Documented training of employees be accomplished on a regular schedule Abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
