Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a crushing and/or struck by hazard:
(a)Junction of 291 Highway & 39th Street, Independence, Missouri.  On or
about
October 31, 2002, two sheets of 4 foot by 8 foot, 3/4 inch thick, plywood
were
placed on a fork lift attachment for a front end loader.  A mini excavator
was
then placed on the platform, chained to the fork attachment and elevated
approximately 8 feet above ground level, exposing the employee and
bystanders
to crushing and/or struck by hazards.
A feasible and acceptable method to correct this hazard, among others are
to follow the
manufacturers' operation manual to only operate the 301.5 mini excavator
on solid
ground; or use another piece of equipment (Gradall) specifically designed
to perform the
work attempted by the mini excavator.
Abatement certification is required for this violation (using the
CERTIFICATION OF
CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating
that abatement is complete must be included with your certification.  This
documentation
may include, but is not limited to, evidence of the purchase or repair of
the equipment,
photographic or video evidence of abatement, or other written records.
