Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a)On or about 12/26/02 at the Lee's Summit Resource Recovery Park, an
employee
was exposed to the hazard of falling out of the Komatsu PC95 excavator
bucket
while being raised out of a trench that was approximately 9-10 feet in
depth.
While ultimate responsibility for correcting the hazard rests with the
employer, given its knowledge of the workplace, feasible and acceptable
methods to correct the hazards, among others, include:
(1)Development and implementation of a training program specifically
addressing safe operating procedures while using an excavator;
(2)Enforcement of company safety rules and policies.
