Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)Hazard observed: combustible material was next to the 1000 gallon propane tank outside of the southwest corner of the building. The tank and combustible material was visible from the general contractor's trailer; he should have been aware of the situation. A fire and / or explosion could have caused serious injury to employees on the site; one feasible and accepted method of abatement was to clean up the combustible materials from next to the tank. Abatement certification is required for this item - use CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.
