Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by moving vehicles: At the jobsite, employer did not follow the Manual on Uniform Traffic Control Devices, Millennium Edition, Chapters 6B and 6D, in that they did not develop a temporary traffic control plan which detailed how employees would access or exit their construction workzone with out bringing them into conflict with vehicles moving through or around the worksite. Employees were allowed to cross on foot, two lanes of west bound traffic on Interstate-30 and two lanes of opposing traffic on the adjacent service road, exposing employees to the hazard of being struck by a moving vehicle.
