North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: a)Facility - an employee allowed to operate a Pettibone wheel mounted crane was not qualified as an operator by meeting the requirements of USAS B30.5-1968, Revised as ANSI/ASME B30.5-1995, Section 5-3.1, Paragraph 5-3.1.1a. Among other feasible methods to correct this, the employer may send the operator to an approved school for training, testing and certification. o/ J y y J p\
