North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck by hazards from a high pressure water hose with pressures up to 3000 psi. a) site; On or about 6 June 2002, an unqualified employee was operating high pressure water hose, 3000 Max PSI, Sewer Jet Truck, Model 747, manufactured by Sewer Equipment Co. of America, to blow mud and debris from water valve box prior to being trained to operate machine. Among other methods, one feasible and acceptable means of abatement to correct this hazard would be to train employees on the use of and PPE required for this equipment using the operator's manual prior to operation.
