North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to being struck by a suspended load on a hydraulic lift. a) Vehicle Maintenance Shop - Periodic inspection procedures, to be conducted and documented by a Qualified Inspector, in accordance with the recommendations of the lift manufacturer or Automotive Lift Institute, Inc. (ALI), to assure the continued safe operation of the lift, were not established. Potential hazardous conditions noted were: leaking oil, sudden erratic movement of the lift during operation, and a non-functioning safety lock system. One feasible and acceptable method of abatement is to establish periodic inspection procedures for the hydraulic automobile lifts, to be conducted and documented by a Qualified Inspector, in accordance with the manufacturer's recommendations and/or the Automotive Lift Institute. North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to being struck by a suspended load on a hydraulic lift. a) Vehicle Maintenance shop, west side - Lift locks on the hydraulic lifts were not operational and properly engaged at all intended points. The owner or employer did not ensure that lock release mechanisms and lock reset devices were operational. One feasible and acceptable method of abatement is to maintain lift locking systems in proper operational condition, allowing the lift operator to use all applicable safety features provided on the automotive lift, in accordance with the manufacturer's recommendations and/or the Automotive Lift Institute. One feasible and acceptable method of abatement is to maintain operating instructions, general safety information, safety tips and warning labels in a conspicuous location in the lift area, in accordance with the American National Standards Institute and/or the Automotive Lift Institute. One feasible and acceptable method of abatement is to identify the manufacturer of the lift, obtain the required information, and permanently affix the information to the lift, in accordance with the American National Standards Institute.
