North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to being struck-by industrial sectional steel vertical rolling door: a)warehouse, loading dock door - 18 ft. wide x 11 ft. high 380 lb. Windsor, industrial sectional steel, vertical rolling door, model no. N244, is hard to open with pull-chain, and comes out of the track when lowered, and has malfunctioning torsion spring, which causes the door to free fall to the floor when lowered by pull chain (ref. Windsor Door Operating Instructions, Preventive Maintenance Schedule and Warning instructions) One feasible and acceptable method of abatement, among others, to correct this hazard is to ensure that a qualified Windsor Door installer, installs a new torsion spring and performs a preventive maintenance inspection to ensure that all components of the door are operating properly.
