North Carolina General Statute 95-129(1) of the Occupational
Safety and Health Act of North Carolina:  The employer did not
furnish each of his employees conditions of employment and a
place of employment free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees in that employees were exposed to hazards associated
with the improper placement and maintenance of LP gas tanks:1)
when damage to LP gas systems from vehicular traffic was a
possibility, precautions against such damage was not taken; and
2) LP containers were not protected by crash rails or guards
(or by location) to prevent physical damage:
a)next to the office, for the LP tank used for heating the building which
was
located 32 inches from a trash dumpster.  Reference: 1910.110(d)(10) and
