North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to improper use of equipment due to missing bolts needed to securely attach the platform on a rough terrain forklift when elevating personnel (IAW para 5.15.1(b) ASME B56.6-1992):. a)site-the platform used on the forks of a rough terrain forklift, SkyTrak model #B8400, serial number P5606B81, was not securely attached to the forks. A feasible means of abatement is to use bolts when attaching the platform to the forks when elevating personnel.
