North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to being struck by a suspended load on an automotive lift. a)Vehicle Maintenance Shop, 2nd bay from the right, on the northeast end of the service area - Periodic inspection procedures, to be conducted and documented by a Qualified Inspector, in accordance with the recommendations of the lift manufacturer, Rotary SafeLift, or Automotive Lift Institute, Inc. (ALI), to assure the continued safe operation of the lift, were not established. Potential hazardous condition noted: Power Unit leaking hydraulic oil. b)Vehicle Maintenance Shop - Lift operators had not been trained in the safe use and operation of the lift using the lift manufacturer's operating instructions; ALI/SM 93-1, ALI Lifting it Right safety manual, ALI/ST-90 ALI Safety Tips card and ANSI/ALI ALOIM-1994, American National Standard for Automotive Lifts-Safety Requirements for Operation, Inspection and Maintenance. c)Vehicle Maintenance Shop - The Owner/Employer did not display the lift manufacturer's operating instructions; ALI/SM 93-1, ALI Lifting it Right safety manual, ALI/ST-90 ALI Safety Tips card; ANSI/ALI ALOIM-1994, American National Standard for Automotive Lifts-Safety Requirements for Operation, Inspection and Maintenance. One feasible and acceptable method of abatement is to ensure that operators of the lifts are instructed in the safe use and operation of the lift using the lift manufacturer's operating instructions, ALI Safety Tips card, and American National Standard for Automotive Lifts-Safety Requirements for Operation, Inspection in accordance with the manufacturer's recommendations in the Rotary SmartLift Owners Manual and/or the Automotive Lift Institute.
