Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed by the forklift or striking an object if the forklift were to tip. a) Outside storage area Employees were operating forklifts without using a component part of the operator restraint system (seatbelts) that is designed to reduce the incidence and severity of injuries to the operator in the event of a tipover accident in the outside storage area where tipping hazards were present. Violation observed on or about 06/20/2002.
