Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Warehouse Area, In South Bay and just outside South Bay - 1806 Harrison Avenue, Kearny, NJ. Employee(s) operating forklifts were not wearing seat belts on forklifts that are equipped with these operator restraint devices. Failure to wear the seat belts increases the risk of injury to the operator especially as forklift trucks are particularly susceptible to tipovers. Violation observed on or about 07/16/02.
