NYSLL, Section 27a(3)(a)(1): The employer did not furnish to each
of its employees, employment and a place of employment which was
free from recognized hazards that are causing or are likely to
cause death or serious physical harm to its employees and which
will provide reasonable and adequate protection to the lives,
safety or health of its employees. In applying this paragraph,
fundamental distinctions between private and public sector
employment have been recognized.
(a)NYSOCFS- Camp Cass Residential Center - Employees were
exposed to the hazard of workplace violence through contact with
residents who may be combative. Reasonable and adequate abatement
methods for reducing this hazard include, but are not limited to,
assuring that employees complete academy based training and
enforcing the facility's own policies regarding head count
procedures and radio policy. The facility should prepare a
written policy on radio usage, as there was none at the time of
inspection.
