North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish to each of his employees conditions of employment
and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to
employees:
a) jobsite; wal-mart on South Tryon - Employee was working on a Lull
approximately 12 feet
high without any type of fall protection.
NOTE: One feasible and acceptable means of abatement is to provide a
safety cage with
guardrails attached to the Lull so that employees may work at various
heights while
being protected from falling.d
