Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) The hazard of falls up to 330 feet due to failure or malfunction of the load line or hoisting equipment in that employees were transported to elevated work locations by use of a load line without a trail lift with the unoccupied load line loaded to the anticipated lift weight, from ground level or any other location where employees would ride the load line to locations at which the load line was to hoist and be positioned. No trial lift was performed immediately prior to placing personnel on load line and the hoist operator did not determine that all systems, controls and safety devices were activated and functioning properly; that no interferences existed; and that all configurations necessary to reach those work stations would allow the operator to remain under 50 percent of the hoist's rated capacity. One means of abatement among others, is to: a) Assure safe work practices identified in CPL 2-1.36, Interim Inspection Procedures During Communication Tower Construction Activities, 03/26/2002, are complied with at all times,including; 1) Conducting a pre-lift meeting attended by the hoist operator, signal person(s), and employee(s) to be lifted; 2) Conducting trial lift prior to lifting personnel to determine all systems controls and safety devices are functioning properly.
