Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
Employees were exposed to being struck by falling loads on or about
05/30/02 while
transporting a loaded concrete form basket on a manually propelled cart /
dolly in that the load
( a form basket and forms weighing 1290 lbs. ) was not stable and safely
arranged, or secured
against falling or tipping. Among others, one feasible and acceptable
method to correct this
hazard would be to implement a method of transporting form baskets that
would ensure the
stability of the load.
Employees were further exposed to being struck by falling loads while
using specialty / job
made below-the-hook lifting devices ( job made lifting baskets ) to handle
concrete
forms with
a boom truck due to the following:
A) The lifting devices had not been proof tested.
B) The lifting devices were not marked to indicate rated load capacity and
lifter weight.
C) There was no documentation to indicate that the lifting devices were
designed to withstand
forces imposed by their intended / rated load with a minimum safety design
factor of 3.
D) There was no documentation to indicate that welding done on the lifting
devices had been
done in accordance with ANSI/AWS D1.1, or equivalent welding
specifications.
E) There was no inspection program in place to ensure that new, modified,
or in service lifting
devices were being inspected by a designated person on an initial basis,
or on a frequent and
periodic basis for lifting devices in regular service.
Among others, one feasible and acceptable method to correct this hazard is
to design, construct,
test, and mark below the hook lifting devices in accordance with the
American National Standard
ASME B30.20c standard for Below-The-Hook Lifting devices.
