Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about June 5, 2002, an employee, traveling on the N. Stemmons Frwy. Service Road, between Valley View Lane and Valwood Parkway, was a passenger on a Case, 580L, front-end loader/backhoe. The employee was riding on the left fender, outside the protection of the cab. Among other methods, one feasible abatement method includes: 1.Enforce the company's work rule to only permit employees to ride on/in vehicles/equipment designed to accommodate passengers.
