Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: 5409 Samuell Blvd., Dallas, TX: On or about May 14, 2003, the employer, not using channelizing devices to close the shoulder, exposed at least two employees, who were walking and working on the shoulder of Samuell Blvd. while repaving a parking lot approach, to the hazard of being struck-by a motor vehicle. Among other methods, at least one recognized and feasible means of abatement includes but is not limit to complying with the requirements detailed in the Manual on Uniform Traffic Control Devices 1988 Edition, Revision 3 or the Millennium Edition.
