Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were required to enter a confined space without assurance that the space was free of flammable, toxic contaminants and oxygen deficiency: Worksite located at intersection of Maple Ln. and Shadywood, DeSoto, TX 75115: On or about June 3, 2003, at least four employees were working in trench. Employees were required to enter into an existing pipe (36-inch diameter) to work inside the pipe. Entry(ies) made into the water pipeline, for the purpose of construction an extension to the pipeline, without assuring acceptable atmospheric conditions for all periods of entry; providing appropriate respiratory and retrieval equipment in the event of an emergency; and assuring a common communication system for monitoring the need for emergency rescue. Among other methods, recognized and feasible means of abatement to correct this hazard include, but are not limited to : Full implementation of the elements required by the American National Standards Institute (ANSI) standard Z117.1 (Safety Requirements for Confined Space).
