Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to moving traffic and subject to being struck by the traffic
while standing in a
partially open lane directing traffic with a flag.
Specifically, the employer assigned a flagman to control traffic for the
purpose of stopping
traffic to allow front end loaders to cross perpindiclar to the traffic
lanes.  The inside lane of
a three lane one-way street was closed by the placement of traffic cones,
and the flagman was
standing outside the cones in the open lanes of traffic.
This hazard is recognized by Section 6E.05 the TxDot Standard
Specifications for Construction
and Maintenance of Highways, Streets, and Bridges, 1995, which states "The
flagger should
stand either on the shoulder adjacent to the road users being controlled
or in the closed lane
prior to stopping road users".  TxDot recommended training requirements
for flaggers specifies,
with emphasis, that "Flaggers never stand in the lane being used by
traffic)".
Among other methods, recognized means of abatement include, but are not
limited to:
1)  Obtain TxDot training manuals and information, and train and instruct
flagmen on proper
positioning and techniques on performing flagging operations.
2)  Create a company safety program which includes periodic inspection of
the job sites to detect
possible violations of safe working practices.
