General-duty citation text
Section 5(a)(1) of the Occupational Health and Safety Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: Outdoor garden center at the Home Depot, Store No. 6555, construction site located at 2011 Keller Springs Road, Carrollton, Texas. The employer, when constructing the garden center masonry piers, did not install the reinforcing steel and fully grout the masonry block cells in accordance with the approved design specifications resulting in unreinforced sections at the base of the piers. The employees, working near and around the masonry piers were exposed to the hazards of being struck and crushed-by overturning and/or collapsing piers. Among other methods, a recognized and feasible means of abatement to correct this hazard includes, but is not limited to: a) Construct the masonry piers in accordance with the approved design specifications.
