Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees:
Outdoor garden center at the Home Depot, Store No. 6555, construction site
located at 2011
Keller Springs Road, Carrollton, Texas.
During the construction of the spandrel panels, the employer used 1/4-inch
diameter by 1-1/2-
inch long nail drive anchors to secure the light-gauge steel frames to the
masonry piers.  The
anchors, designed for light-duty applications, were not capable of
withstanding the wind load.
Employees working near, around and under the spandrel panels were exposed
to the hazards of
being struck and crushed-by the overturning and/or collapsing panels.
Among other methods, recognized and feasible means of abatement to correct
this hazard
include, but are not limited to:
a)Construct and secure the spandrel panels in accordance with the approved
design
specifications; or,
b)Submit a Request For Information (RFI) to the professional of record for
clarification of the proper installation procedures.
