Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: Worksite located at Two Centre & IH 635, Mesquite, TX 75105: On or about 9/9/03, at least six employees, who were making paving for bridge walkway, were exposed to the hazard of being struck-by vehicles. The employer did not ensure that the channelizing devices were properly used and positioned, and/or a flagger(s) was used to safely control and direct the flow of traffic past the work area.
