Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: On or about February 19, 2004, employees working in the Production area were exposed to the hazards of failing structural members: a) All along the wall adjacent to the Presses, precipitation was not prevented from coming into contact with an air compressor, electrical outlets, and breaker boxes. b) On the side of the building opposite the Presses, there was deep mud from excessive rain coming into contact with the dirt floor.
