Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: On or about February 19, 2004, employees entered into the 108-inch diameter water pipeline, for the purpose of construction, without assuring acceptable atmospheric conditions for all periods of entry; providing approximate respiratory equipment in the event of an emergency, and assuring a common communication system for monitoring the need for emergency rescue. Among other methods, recognized and feasible means of abatement to correct this hazard include, but are not limited to: a) Full implementation of the elements required by the American National Standards Institute (ANSI) Standard Z117.1 (Safety Requirements for Confined Space). b) Full implementation of the elements outlined in the National Utility Contractors Association (NUCU) Confined Space Entry Manual.d
