Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards and struck-by hazards from cranes being operated with defective brakes. a) Scrap Yard: C-070 locomotive cranes: Brakes did not work properly and/or were disconnected, exposing employees working on the ground near the cranes to struck-by and/or crushing hazards. Among others, one feasible and acceptable method to correct this hazard is to comply with the requirements of the American Society of Mechanical Engineers, B30.5 - 1968, Crawler, Locomotive and Truck Cranes, Section 5-1.5.3, Travel Brakes and Locks, which requires locomotive cranes to be equipped with proper brakes.
