Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the potential failure of the drilling rig due to the employer using a 1972 model IDECO 103-300 that was not labeled consistent with American Petroleum Institute's (API) Specification 4F, Specification for Drilling and Well Servicing Structures, which requires that drilling and well servicing structures be provided with a nameplate indicating the ratings for the maximum static hook load, guy lines applicability, and maximum rated wind velocity with rated capacity of pipe rack, as observed on August 5, 2003.
