Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being thrown from the operator's station, in that, operators were not wearing a seatbelts while operating powered industrial trucks: a. Yard - An employee operates a Clark fork lift truck installed with a seatbelt. While operating the fork lift truck, the employee was not wearing a seatbelt as observed on 5/27/03. ABATEMENT NOTE: A feasible and acceptable method of abatement of this hazard would be to enforce the use of seatbelts during operation of any powered industrial truck.rial
