Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazarads that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to a fall hazard estimated to be approximately 8-9 feet while working in the elevated bucket of a loader: a.Horner United Methodist Church - An employee was performing work while standing in the bucket of a Bobcat 773 loader. The bucket was extended approximately 8-9 feet above the ground, as observed on 03/04/04. Among other feasible and acceptable methods to correct this hazard are to: 1. Prohibit employees from using the elevated bucket of the loader as a work station. 2.Utilize acceptable devices such as ladders, scaffolding or aerial lifts for employees working elevations, as the employer states is normally the case.
