Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls and crushing hazards. a) Construction site - Employees were standing in the bucket of a John Deer 310 Backhoe Loader, while being raised and lowered to the work area, exposing the employees to falls and crushing hazards on or about 4/25/02. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to prohibit the practice of employees riding in the backhoe's bucket, as referenced by the John Deer 310's Operator's Manual, OMT184374 AO.184374
