Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being thrown from the rough terrain forklift during a roll over of the equipment: On or about 4/24/02--the rough terrain forklift being used to deliver marble had the seat belt removed. One feasible method of abatement is to install a new seat belt on the rough terrain forklift.
