Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish to each of his employees employment and a
place of employment
which were free from recognized hazards that were causing or were likely
to cause death or
serious physical harm to employees in that employees were exposed to the
hazards of being
struck by overturning equipment:
On or about 2/10/03 an employee near 3400 NE 213 Street was exposed to
being struck by an
overturning Bobcat X 320 excavator while operating it because the employer
did not require the
use of an operator restraint device.
Among other methods, one feasible abatement method to correct the hazard
is to require the use
of seatbelts.
