A.R.S. 23-403.A.: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that the employer did not require all operators of powered industrial trucks to wear restraint devices (seat belts), during the operation of industrial trucks in accordance with American National Standards Institution (ANSI) B56.1, for powered industrial trucks, and American Society of Mechanical Engineers (ASME) B56.1- 2000 - Safety Standard for Low Lift and High Lift Trucks. a)7145 Leupp Rd., Flagstaff, AZ, 86004: The employer did not enforce and ensure the wearing of seat belts during operation of industrial trucks to protect the operator in the event of a roll over.
