Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or physical harm to employees in
that employees were
exposed to:

El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
In the platform, in the south area of the "Tren Urbano, Sagrado Corazon",
there was an
employee installing soffit panels on the celling.  He was in a man lift
identified
as
ABLD4006, Model SJKB40IC and Serial Number 95102 when it overturned onto
rail
tracks. The employee was at approximately  12 feet in height in the basket
from the man
lift to the platform, at approximately 4 feet height of the platform  to
the rail tracks and
at approximately 7 inches from the edge of the platform. The  Supervisor
was in  another
man lift simultaneously. The General Contractor did not have effective and
continuos
supervision for Springbok construction, Inc., that identified the
predictable fall hazard
to the employee and  did not develop  corrective  measures to eliminate
the hazard.
Hazard: Fall and overturned of the machine.
Amoung other to correct this hazard is provide a hazard safety analisys of
the  worplace
before start to work and supervise that the employee  have a safe
practice.
En la plataforma, en el area sur del Tren Urbano, Estacion de Sagrado
Corazon, habia
un empleado  instalando  paneles en el plafon del techo. El estaba en un
man lift'
identificado como ABLD4006, Modelo SJKB401C y Numero de Serie 95102 cuando
se
volco sobre los rieles del tren. El empleado estaba a aproximadamente 12
pies de altura
de la canasta del man lif' a  la plataforma, aproximadamente 4 pies de
alto de  la
plataforma  a los rieles y aproximadamente  7 pulgadas del borde de la
plataforma. El
Supervisor se encontraba en otro man lift' simultaneamente. El Contratista
General no
tenia una efectiva y continua supervision para Springbok Construction,
Inc. que
identificara los riesgos a caida  predecibles y no tenia desarrollado
medidas corectivas
para eliminar el riesgo.
Riesgo: Caida y vuelco del equipo.
Entre  otros metodos  para corregir este riesgo es proveer un analisis de
riesgo
de
seguridad  del lugar de trabajo antes de comenzar a trabajar y supervisar
que los
empleados tengan unas practicas seguras.s
