Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or physical harm to employees in
that employees were
exposed to:

El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
At establishment under construction west area, Bed, Bath & Beyond of the
San Patricio
Plaza Shopping Center: the employees were installing the angles in the
wind wall of the
establishment. They were on a scissor lift, trademark Marklift, model
M20ESEP, serial
69020675, when one of the employees went to the left side, the case came
loose
on the
opposite side, falling off the employees and the case from an approximate
height of 15
feets. The employer did not realize a structural inspection to the scissor
lift, so it
identifies the defects in the structure of it, as specified on the owner's
manual, that it has
to be inspected at least monthly.
Hazard: Falls due to the loosen up of the case.
Among other methods, one feasible and aceptable method to correct this
hazard is make
the structural inspections to the scissor lift at least monthly, to
maintain the equipment
in optimal conditions.
En el area oeste del establecimiento en construccion "Bed, Bath & Beyond"
del centro
comercial San Patricio Plaza: los empleados estaban instalando angulares
en el alero del
establecimiento. Ellos estaban en un "scissor lift", marca Marklift,
modelo M20ESEP,
serie 69020675, cuando uno de los empleados se fue hacia el lado
izquierdo; el cajon se
desprendio en el sentido contrario, cayendo los empleados y el cajon de
una altura
aproximada de 15 pies. El patrono no realizo una inspeccion estructural al
"scissor lift",
de manera que identificara defectos en la estructura del mismo, segun
indica el manual
del manufacturero, que debe de revisarse por lo menos una vez al mes.
Riesgo: Caidas debido al desprendimiento del cajon.
Entre otros metodos para corregir este riesgo es realizar una inspeccion
estructural al
"scissor lift" por lo menos una vez al mes, para poder mantener el equipo
en optimas
condiciones.
