Title 21 V.S.A. Chapter 3, Subchapter 5, Section 223 (a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause death or serious physical harm to employees, in that employees were exposed to: falling objects from a crane Location: The base section of the PGI Tower Crane 3, right side of the base. Violation: The employer did not provide protection from falling objects and tools such as a cell phone, for employees working in the area of the base section of the tower crane, when employees were working in the trolley motor and control switch section of the jib. Among the feasible abatements to this hazard the employer can institute are; A) construct railing systems with toe boards and screens, sufficient to protect from the hazard, B) construct canopy systems to protect lower levels, or, C) construct barricades around the area in which the exposure to falling objects exists and prohibit employee access to these areas.
